1. About DelayPay

DelayPay ("we", "us", "our") is a trading name of TGT Systems Ltd, a company registered in England and Wales. Our website is delaypay.me.

DelayPay is a flight delay referral service. We help air passengers determine whether a delayed, cancelled, or disrupted flight may qualify for compensation under EU Regulation 261/2004 ("EU261") or UK Regulation 261 ("UK261"). If your flight qualifies, we connect you with an independent claims partner who can pursue the claim on your behalf.

We are not a claims management company (CMC), a law firm, or a legal advisory service. We do not process, manage, or pursue compensation claims ourselves. We do not hold FCA authorisation and are not required to, as flight delay claims under EU261/UK261 are not regulated financial services.

2. Acceptance of terms

By submitting the form on our website, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our service.

You confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.

3. Our service

When you submit your flight details through our form, we:

1. Record your flight number, departure date, number of passengers, email address, and country of residence
2. Verify the actual arrival delay of your flight using third-party aviation data providers after the flight has landed
3. Determine whether the delay meets the threshold for compensation under EU261 or UK261 (generally 3 hours or more at arrival)
4. Calculate the approximate compensation amount based on flight distance (€250, €400, or €600 per passenger)
5. If your flight qualifies, email you a link to our claims partner where you can start your claim

Our service up to this point is entirely free. You do not pay DelayPay any fee at any stage.

4. Claims partner

If your flight qualifies for compensation, we refer you to an independent claims partner. Our current partner is Compensair, but we may work with other partners from time to time.

When you click the link in our email and proceed to the claims partner's website, you enter into a separate agreement with that partner, subject to their own terms and conditions, privacy policy, and fee structure. We encourage you to read their terms carefully before proceeding.

The claims partner typically operates on a no-win-no-fee basis and charges a success fee (usually 25–35% of the compensation received). This fee is between you and the claims partner — DelayPay does not add any additional charge.

5. Affiliate disclosure

DelayPay receives a referral fee from our claims partners when you submit a claim through our referral link. This fee is paid by the claims partner, not by you, and does not increase the amount you pay or reduce the compensation you receive.

This referral arrangement is the way we fund our free flight-checking service.

6. Accuracy of information

You agree to provide accurate and truthful information when submitting the form. We rely on your input (flight number, date) and third-party aviation data to verify your flight. While we take reasonable steps to ensure accuracy, we cannot guarantee that the data from third-party providers is complete or error-free.

Our assessment of whether your flight qualifies for compensation is indicative, not legally binding. The claims partner will perform their own independent assessment when you submit a claim with them.

7. No guarantee of compensation

DelayPay does not guarantee that you will receive compensation. Several factors outside our control can affect a claim, including but not limited to:

• The airline may dispute the delay or claim extraordinary circumstances
• The aviation data we rely on may differ from the airline's records
• The claims partner may assess the case differently
• The applicable statute of limitations may have expired

Our service is a preliminary check, not a legal opinion or a promise of outcome.

8. Intellectual property

All content on this website, including text, design, code, and branding, is the property of TGT Systems Ltd and is protected by UK copyright law. You may not reproduce, distribute, or create derivative works from our content without written permission.

9. Limitation of liability

To the maximum extent permitted by law:

• DelayPay is provided "as is" without warranties of any kind, whether express or implied
• We are not liable for any loss, damage, or expense arising from your use of our service, including any decision to pursue or not pursue a compensation claim
• We are not liable for the actions, omissions, delays, or failures of our claims partners or any third party
• We are not liable for any inaccuracies in flight data provided by third-party aviation data providers
• Our total liability to you for any claim arising from your use of our service is limited to £100

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify TGT Systems Ltd against any claims, losses, or expenses arising from your breach of these terms, your provision of false or misleading information, or your misuse of our service.

11. Third-party links

Our website contains links to third-party websites (claims partners, aviation data sources, Meta). We are not responsible for the content, accuracy, or practices of those websites. Your use of third-party sites is governed by their own terms.

12. Modifications

We may update these Terms and Conditions at any time. The "last updated" date at the top reflects the most recent revision. Continued use of our service after changes constitutes acceptance of the revised terms.

13. Severability

If any provision of these terms is found to be invalid or unenforceable by a court, the remaining provisions remain in full force and effect.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
